The California Consumer Privacy Act (CCPA) and the recently passed California Privacy Rights Act (CPRA) are the most comprehensive industry neutral data privacy rules to be enacted in the United States. After years of high-profile privacy scandals and as more companies become victims of cybercrime, lawmakers are responding by adopting robust rules that protect the personal information that consumers entrust to a wide range of businesses every day. This presentation will detail the origins, applicability, and requirements of the CCPA and the CPRA, as well as practical compliance considerations for startups and entrepreneurs.

Kit Garcin

Allen Matkins corporate attorney Kathryn (Kit) Garcin specializes in data privacy, information security, intellectual property and technology transactions, and other commercial contracts. In her privacy practice, Kit regularly works with clients to design and implement data privacy, information security, and risk management programs. Kit provides clients with creative and practical advice on meeting the requirements of state and federal privacy laws, including the California Consumer Privacy Act (CCPA), Children’s Online Privacy Protection Act (COPPA), and the Fair Credit Reporting Act (FCRA). She crafts guidelines and compliance programs for clients’ collection, use, and disclosure of personal information in diverse contexts and for diverse clients including investment funds, national residential and commercial property management companies, and market research firms. Her work includes drafting privacy and cookies policies and online service terms of use, assessing and managing privacy risks, including in connection with vendor contracts and corporate transactions, and negotiating privacy and security terms and agreements. Kit also counsels public and private companies in a diverse range of industries, including, food & beverage, technology, real estate, financial services, and manufacturing in matters of corporate governance, intellectual property transactions, and the regulation of financial services and securities, both domestic and international.
